法律类的文章相对比较专业些,我们中口阅读只要了解一些常用的法律术语就可以了,以下是我们上课笔记的补充。

I. 法庭上的人

1. judge 法官,被称为"Your Honor", 注意这两个单词要连读。

   法官的座位:bench

   法官的责任:sentence (判决) summon / call (传唤) pass sentence on sb / pronounce(宣判)

   法官在法庭上常说的两个词:overruled (反对无效),sustained (反对有效)

   法官会经常说一句话:You should govern your temper.  / keep a calm sough. / keep mum. / keep quiet.

2. jury 陪审团由12个 juror陪审员构成

   陪审席:jury box

   陪审团的责任:verdict (裁决)

   陪审团在作出裁决前要一起协商:deliberation

3. 原告:plaintiff (civil case 民事案中)

    检控方:the prosecution (criminal case 刑事案中)

    控方律师:the prosecution attorney

    美国地方检察官:District Attorney 简称DA

4. 被告:defendant

    辩方律师:defense attorney ( 毕业论文答辩也叫defence)

    英国的出庭大律师:barrister;   不出庭的小律师:solicitor

5. 嫌疑犯:the suspect

   罪犯:the criminal / the convict / the culprit

   受害人:the victim

   证人:witness 给出的证词:testimony

II. 法庭上的动词

1. book 做笔录,备案

2. transcribe 记录证词

3. deliberate 陪审团协商

4. verdict 陪审团裁决

    render 做出(裁决)e.g. The jury has rendered its verdict. 陪审团已经做出了裁决

5. sentence 法官判决

    pass sentence = pronounce 宣判

    suspended sentence = probation 缓刑 

    serve a sentence 服.....刑

6. sue sb for sth 起诉某人 (in civil case)

    accuse sb of sth 指控某人 (多用于criminal case )

    charge sb of sth 指控某人 (刑事、民事都可用)

7. testify 证人作证

8. breach 破坏,违反

III. 法律名词

1. lawsuit:官司

2. oath:法庭誓言 take an oath to tell the truth

   "I swear to tell the truth, all the truth, nothing but the truth."

3. bail:保释金(支付保释金put up bail )

4. hearing:听证会

5. alibi:不在场证据 e.g. He established an alibi to the charge of murder. 他证实在谋杀案发生时他不在场。

6. 法庭:court / courtroom / a court of law / forum / tribunal

   " You have the right to remain silent, and refuse to answer question. Anything you do say may be used against you in a court of law."  你有权保持沉默,但你所说的将成为呈堂证供。

IV. 法律罪名

1. fraud 诈骗罪(securities fraud 股票诈骗/ insurance fraud 保险诈骗/ tax fraud 税收诈骗)

2. felony 重罪

3. holocaust 种族大屠杀

4. arson 纵火罪

5. money laundry 洗钱

6. pyramid scheme 金字塔骗局(传销)

7. domestic violence 家庭暴力

8. perjury 伪证罪

伪证罪最早出自于圣经,下面是上课讲的十戒的原文:

Moses called together all the people of Israel and said to them, "People of Israel, listen to all the laws that I am giving you today. Learn them and be sure that you obey them. At Mount Sinai the Lord our God made a covenant, not only with our fathers, but with all of us who are living today. There on the mountain the Lord spoke to you face-to-face from the fire. I stood between you and the Lord at that time to tell you what he said, because you were afraid of the fire and would not go up the mountain.

"Respect your father and your mother, as I, the Lord your God, command you, so that all may go well with you and so that you may live a long time in the land that I am giving you."

"Do not commit adultery."
"Do not steal."
"Do not accuse anyone falsely."
"Do not desire another man's wife; do not desire his house, his land, his slaves, his cattle, his donkeys, or anything else that he owns."
